When a suspected drunk driver causes an accident resulting in injury to another person that alleged drunk driver may be held civilly liable for the results of their actions even if they may also be facing criminal charges. Furthermore if the reported drunk driver was over-served alcohol at a negligent bar or restaurant prior to the wreck the alcohol-serving establishment may also be held civilly liable for the accident insofar as a connection can be shown from the bar to the driver to the accident. This is due to dram shop laws that exist in most states. However a thorough investigation must often be conducted in order to ascertain whether such a chain of events may have been a contributing factor to this unfortunate accident.

When a suspected drunk driving accident occurs in Texas Texas dram shop law works to hold more than just the alleged drunk driver accountable for his or her actions. If the suspected drunk driver was provided too much alcohol at a bar or restaurant prior to the wreck (a tragically common occurrence) then the alcohol-serving establishment may have breached dram shop law. If it can be proven that the alleged drunk driver was over-served prior to causing a wreck then the bar or restaurant can also be held civilly liable for the outcome of such an accident. However a thorough third party investigation must often be conducted in such instances to ensure that the liable parties are correctly identified and held accountable for their negligence that may have resulted in such an unfortunate accident.
