According to recent news reports from New Bern North Carolina 44-year-old Dennis Driver was struck by a suspected drunk driver while riding his moped on Sunday July 3. The accident happened around 2 a.m. as Driver was on Neuse Boulevard and was turning left into a Sonic restaurant when Jenna Davis of New Bern struck Driver. He was thrown to the pavement and later taken to Pitt County Memorial Hospital. He was last listed in serious condition. Davis has been charged with DWI. Further charges are pending.

Commentary
When an injury accident occurs caused by a suspected drunk driver entities other than the alleged drunk driver may also bear civil liability for the consequences of the wreck. Dram shop laws in most states work to hold negligent bars or restaurants accountable for their actions in over-serving patrons such that they exceed a BAC level of .08%. If such an intoxicated patron then causes injury to themselves or others the entity that over-served them alcohol may also be held civilly liable for the injuries. If such a series of events may be suspected of having been a contributing factor to this unfortunate accident a third party investigation may be conducted to ensure that all liable parties are identified and held accountable for their negligent behavior.
