When an injury accident is the result of the alleged reckless behavior of a suspected drunk driver multiple parties may be held civilly liable for the results of the accident. For instance if the alleged drunk driver was over-served alcohol at a bar or restaurant prior to the accident the alcohol-serving establishment may be held partially liable for the consequences of their own negligent actions in plying a patron with too much alcohol. This type of liability exists through New Mexico dram shop law. However such a series of events must be proven to have occurred prior to the accident and a third party investigation may be pursued that can assess such issues.
