Two TXDOT Workers Struck by Suspected Drunk Driver on Hwy 69 in Lumberton, TX

According to recent news reports from Lumberton Texas two TxDOT workers have suffered serious but non-life-threatening injuries after being struck by a suspected drunk driver on Thursday July 1 around 1 a.m. 24-year-old Lester Juneau III struck equipment that the contract workers were using then hit the men. One of the injured victims suffered leg injuries the other suffered head injuries. Juneau has been charged with two counts of intoxication assault. He is now in the Hardin County Jail. He has a prior DWI conviction for December 2010.

Commentary

When a suspected drunk driving accident occurs in Texas Texas dram shop law works to hold more than just the alleged drunk driver accountable for his or her actions. If the suspected drunk driver was provided too much alcohol at a bar or restaurant prior to the wreck (a tragically common occurrence) then the alcohol-serving establishment may have breached dram shop law. If it can be proven that the alleged drunk driver was over-served prior to causing a wreck then the bar or restaurant can also be held civilly liable for the outcome of such an accident. I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.
