When a suspected drunk driving accident occurs in Texas Texas dram shop law works to hold more than just the alleged drunk driver accountable for his or her actions. If the suspected drunk driver was provided too much alcohol at a bar or restaurant prior to the wreck (a tragically common occurrence) then the alcohol-serving establishment may have breached dram shop law. If it can be proven that the alleged drunk driver was over-served prior to causing a wreck then the bar or restaurant can also be held civilly liable for the outcome of such an accident. However a thorough third party investigation must often be conducted in such instances to ensure that the liable parties are correctly identified and held accountable for their negligence that may have resulted in such an unfortunate accident.
