DWI Drinking over the holidays

One of the most obvious errors that I see in terms of DWIs is when people think that they can drink at a bar and drive home and not get caught.  If you were a police officer and you wanted to catch people drinking and driving where would you hang out?  Surprise!!!  Police officers hang out just around the corner from the major bars in your area.  So as people leave the bar get in their car and drive off….guess who is waiting for them right around the corner.  What is the moral of the story…answer…if you plan on drinking stay at home or get a designated driver who had not had a thing to drink.

On Thursday December 20 2007 a tragic accident occured on the Dallas North Tollway.  Debris from an accident on the opposite side of the road flew through the window of Mr. Bill Bonds vehicle resulting in his death.  It is unclear at this point how the accident on the opposite of the Tollway actually occured but the Texas Department of Public Safety would be in the process of performing a thorough investigation into the events of the accident.

The Department will usually produce an in depth police report accompanied with affidavits from witnesses and pictures/video.  A Freedom of Information Request should cause the Department to forward the report and all relevant evidence to whomever makes the request.

From a legal point of view this case would have both a criminal and a civil element.  The District Attorneys Office and the Dallas Police Department may decide to investigate the driver of the pickup truck for any possible criminal wrong doing.

A civil law firm would pursue any monitary damages which may be owed to Mr. Bonds family.

It is in the best interest of everyone in an accident that was as severe as this one to hire legal counsel as soon as possible because all evidence would need to be gathered immediately.  Having a private attorney would help to ensure that this would take place.

The fact that this happened during the holidays magnifies how tragic this situation really is.
