Eric Woodward 39 apparently suffered a seizure when his Ford Crown Victoria veered onto a sidewalk and struck a mother and her 4-year-old child that was in a stroller. The mother and child were thrown approximately 20 feet. They were taken to Western Medical Center – Santa Ana. The child was in critical condition. The mother suffered a broken shoulder. The accident took place around 10 a.m. on Wednesday October 20 in the 1200 block of East McFadden Avenue in Santa Ana California. Woodwards mother was a passenger in the Victoria and grabbed the steering wheel when she believed her son was having a grand mal seizure. According to Santa Ana police Captain Anthony Bertagna she overcompensated which caused the car to jump the curb and strike the mother and child. Woodward and his mother were not injured in the accident. Woodward was an unlicensed driver due to his medical condition. Charges have not been filed although Bertagna noted that a lot depends on what happens to the kid.

Negligence that causes injury or harm can occur in any number of ways. It would appear from this news report that the driver of the car was acting negligently in that he was not licensed because of his medical condition. In other words the possibility of an accident occurring due to the occurrence of a seizure was likely high.
