Now, in the grand majority of cases, an accident like this is going to be handle through an employer’s workers’ comp policy. As many know, worker’s comp pays out benefits in the case of an on-the-job accident. In most accidents, workers’ comp is an employees only form of recourse. However, it’s not the only way an accident like this could be handled. If the equipment involved the accident had somehow malfunctioned and that malfunction had led to the accident, then liability for the accident could possibly fall on the manufacturer. Obviously, further investigation into the accident is needed. In thee cases, independent investigation are always recommended, as an OSHA investigation can literally take months before completed. When the fact that victims have only a limited amount of time following an accident in which to take action is taken into account, months and months of waiting can begin to look like a lot of wasted time.
