Commentary:

News reports said that the Salvation Army truck was cited for failure to yield after the accident. What does this mean? Well, it depends really. The citation can be fought in court, just like you can fight a speeding ticket. The driver of the truck has the same rights to due process as you do, and they are free to exercise them. That being said, if the driver simply pulled out into traffic like the news made it sound, then the citation will more than likely be a help. Just don’t make the mistake of thinking that fault and citations are mutually exclusive.

Secondly, I’m really wondering just how this accident happened. Did the driver not look at the traffic? Was he not keeping out a watchful eye as every driver is supposed to? It certainly sounds that way from the news, and I’d need to see all the facts before I said anything concrete, but from everything I’ve seen and compiled from the accident, it sounds like the delivery truck is going to take the lion’s share of the fault.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
