Commentary:
Even though it doesn’t sound like a very significant detail, determining if the buses were private charters, or actual school district buses is very, very important? Why? Because dealing with a private charter and dealing with a government vehicle are two completely different animals. If the buses were private charter buses, as many schools use for field trips, then the claim would be against a private company, and compared to a claim against the government, would be a fairly straightforward process. On the other hand, if the buses were actual ISD property, then things are much more complex. The government has equipped itself with a ‘legal bulletproof vest’ when it comes to claims and suits. Usually this is in the form of dramatically reduced statute times, so moving quickly, and getting to the punch first almost always turns out better than the alternative.
