Commentary:
Texas is one of the few states blessed with a very forward-thinking policy when it comes to alcohol-related accidents. Many states currently have what we in the legal industry like to call third party laws, where bars can be liable if their customer hurts somebody else, but Texas is lucky enough to have first party protections as well. If any customer at a bar, or other licensed liquor establishment causes an accident after they were served beyond the point of intoxication, the bar can be held liable for both their customer, and anybody else on the road’s damages. If at any point the bar could have done the right thing, and cut somebody off, they could have prevented an accident, and need to answer for why they didn’t.
