Commentary:
The news report said that the victim may have been crossing the street before they were struck, which opens up a whole new set of questions? Was the victim in a crosswalk? Did the victim have the right-of-way? Was the lighting in the area sufficient enough to illuminate the street where the victim was walking? Did the pickup truck that hit him have time to react, or not? If the driver had plenty of time to react, even if the victim did not have the legal right to be in the road, the driver could still be faulted for the accident.
