Heavener, OK — A woman was sent to the hospital after being involved in a single-vehicle car accident in Heavener, Oklahoma, on Wednesday, January 7, 2015. The accident happened on Route 128, around 8:45 in the evening.
Reports say that 29-year old Jennifer Jumper was a passenger inside a vehicle being driven by 38-year old Jimmy Perez. Reports say that Perez was headed west on 128 when he drove off the road. He over-corrected, which sent his car tumbling until it crashed into a tree.
Paramedics responding to the scene took Jumper to St. Francis Hospital in Tulsa, Oklahoma. Reports say she suffered serious head and internal injuries. Perez was uninjured.
The accident is still being investigated. Officials are sure what caused Perez to drive off-road, as conditions on the road were dry and clear at the time.

Commentary
How this accident is handled forward is going to depend largely on what exactly caused it. If it was found that the crash happened because the driver just wasn’t paying attention to the road, then he could be held liable for his passenger’s injuries. Drivers have a legal obligation to create a safe environment for those they’re driving with. If they fail to live up to that obligation and cause an accident, then the relationship between the injured passenger and the driver would be like that between any two drivers who had gotten into an accident out on the road, with the party not at fault having the right to make sure that their injuries are covered by the driver.
