Sarasota, FL — A man was critically injured in a motorcycle accident in Sarasota, Florida, on Sunday, December 14, 2014. The accident took place on near Braden Avenue, around 3:30 in the afternoon.

According to reports, the injured man was identified as Jacob Ballew. Ballew was headed south when Matthew Kroeger, headed north on 41, stopped to make a u-turn and drove into his path. Ballew collided with his car and was thrown close to 100 feet.

Police cited Kroeger for making an improper u-turn, while Ballew was cited for not having a permit to ride a motorcycle.

Commentary

Police say that Ballew wasn’t licensed to ride a motorcycle. Regardless, that wouldn’t give every passing driver the right the crash into him. The long and short of it is, the driver should have been paying closer attention to the road. He failed to stop for the victim, so it’s possible he could be held liable for the accident. However, it’s important to remember that in accidents like this, even if the police find someone liable for an accident, that doesn’t make them obligated to pay for your medical bills, or in any way make things right with you. That whole side of things is always left to the victim to pick up the ball with. Insurance companies don’t pay anyone unless they’re compelled to.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
