Pollocksville, NC — Officials have reported an accident involving a dump truck and a passenger vehicle in Pollocksville, North Carolina. The accident took place on Highway 17, near Ten Mile Fork Road.
Details surrounding the accident are still unclear. Officials have reported that the dump truck collided with a car, around 6:30 in the morning.
The names of those involved have not been released. We still do not know whether factors such as speed or alcohol contributed to the accident.

News reports have said that it was the dump truck that collided with the car. So, there are a couple of ways this accident can go. If the dump truck is owned and operated by the city, then sovereign immunity would apply, and the driver of the truck would largely be protected. For several reasons that make perfect sense, and a few others that don’t, recovering damages from a municipal entity is very difficult. Not impossible, but difficult.
Now, if the truck is privately owned, that changes everything. Anyone injured in the accident would then have a claim against the company and a right to recover damages. Still, a few questions that need to be answered before moving forward.
