UPDATE: Marcos Ledzema Killed in Motorcycle Accident in Brea, California


BREA, CA — A motorcyclist was killed in a wrong-way accident that happened in Brea, California on Tuesday, May 27th, 2014, according to an article fro the Whittier Daily News.

Police say 20-year-old Marcos Ledzema was killed when the motorcycle he was on collided head-on with another vehicle while driving on The Imperial Highway just before 11:30 Tuesday night. It is believed that the motorcycle drifted into the wrong lane while trying to pass.

Marcos Ledzema was pronounced dead after the accident. No other injuries were mentioned in the news report.

The investigation into the accident is currently ongoing.

Commentary:

The fact that it was reported that this victim was entrusted with a motorcycle, and the owner knew that the victim had little to no experience with motorcycles could be considered negligent instrument. Negligent Instrument happens when somebody is trusted with an object or vehicle while the owner is clearly aware that the recipient is either unfit or incompetent to operate it. Handing the keys to a sport-bike to an inexperienced rider is no different than handing a loaded gun to a blind person. Furthermore, if the victim had no license to operate a motorcycle, things can be compounded further. Either way, based on what I see in the news, the owner could be liable for the accident.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
