LUBBOCK, TX — One person has been killed after a crash in Lubbock, Texas on Sunday, May 18th, 2014, according to a report from My Fox Lubbock.
Police have said that they have reason to believe that 22-year-old Aaron Osborn was killed when the car he was a passenger in crashed into another vehicle while changing lanes on Loop 289.
Scene of the Accident
Aaron Osborn was pronounced dead on the scene after he was ejected from the vehicle in the crash.
The driver of the vehicle was identified in the report as Scott Bednorz, who was taken to a nearby hospital after the accident.
Texas State Police are still handling the accident investigation.
I’d be inclined to believe that the driver of the first vehicle could be facing liability in the accident. What makes me think this? Simply put, any time a person gets into a car as a passenger, they have entered into a contract with the driver. The contract essentially states that they will drive in a safe manner, and will not drive in a way that will harm the you, themselves, or anybody else on the road. If the driver failed to check his mirrors before changing lanes, they have violated this contract and could be liable for the accident.
