RALEIGH, NC — One person is dead after a major accident that happened in Raleigh, NC on Saturday, April 26th, 2014, according to WRAL.
Authorities working with local accident investigation teams have said that they believe 67-year-old Rex Todd was killed when the vehicle he was driving was struck head-on by a vehicle that crossed over the median from the lanes of oncoming traffic while driving on Interstate 440.
Scene of the Accident
Rex Todd was killed in the crash, although it is not clear if he was killed instantly in the crash, or if he was taken to a nearby hospital where he died a short time later.
The driver of the vehicle was identified as Jacob Press, who currently faces drunk driving related charges in connection with the crash.
Commentary:
In accidents where alcohol is determined to be a factor, determining the whereabouts of the offending driver should be the highest priority. Why? Because if the driver had come from a drinking establishment, the bar could be liable for the accident, depending on how the accident happened. Some people do not see this as fair, but many lawmakers saw no difference between a bar and alcohol, and a medical doctor with prescriptions. If a doctor misprescribes a medication, and their patient gets in an accident due to the mistake, the doctor could be liable for the accident. In the same manner, if a bar serves somebody too much alcohol in a short period of time, or serves alcohol to an already-drunk person, they could be liable for the accidents their customer causes.
