Commentary:
My heart always sinks when I see a suspected alcohol related accident occur in a state that has no liquor liability laws. In the State of Texas, lawmakers gave people the ability to distribute justice to both the alleged drunk driver should be found guilty, in addition to the establishment that failed to serve them in a responsible manner. What does this mean? Well, a bartender or server at an alcohol serving establishment has both the ability and the obligation to cut a clearly intoxicated person off once they show symptoms of drunkenness. If they fail in their duty, and the driver leaves to cause an accident, both the driver and the bar are open for punishment, and both should be punished harshly and equally.
