According to local reports a motorcyclist is dead and his passenger serious injured after striking a SUV in Houston Texas. The accident occurred on Highway 6 near Voss when the 2003 GMC Yukon left a private driveway and hit the southbound 2008 Suzuki motorcycle about 11:30 p.m. Thursday July 21. Authorities pronounced the man dead at the scene while his passenger was helicoptered to Memorial Hermann-The Texas Medical Center. Names and details of injuries are being withheld pending investigation.

Commentary
There are two sides to every story and an independent investigation will probably be necessary to establish liability. The driver of the SUV has an obligation to cede right-of-way to the oncoming traffic from the highway. On the other hand if the authorities investigation shows that the motorcyclist was speeding that would mitigate the SUVs liability. Once there is a better understanding of what occurred the victims will be in a position where they can determine if they have a valid cause of action for a suit.
