Lake Rayburn, TX — 31-year-old Nicholas Wise and 45-year-old Jimmie Mercer were injured in a single-vehicle tanker truck accident that occurred on Saturday morning, November 28.
According to police, Wise was driving the tank when he allegedly went too fast while trying to turn from U.S. highway 96 onto RR-255. The truck rolled on its side during the turn, and Wise and Mercer were both rushed to Christus Jasper Memorial Hospital.
Police are still investigating to find out what other factors may have contributed to the collision.

Commentary:
If a driver of a large commercial vehicle like a tanker truck crashes because the driver was going too fast, driving while distracted, or is at fault for any other reason, not only does the driver have responsibility for any injury or death caused, but so does the company that he or she works for.
In the event that a passenger is riding in the commercial vehicle, and that passenger is not also working for the company at the time, they would have rights just like another person in a passenger vehicle might have. The driver, and therefore, the company, would have to take responsibility for any injuries or deaths inflicted on the passenger in that vehicle.
In this particular case, it isn’t clear if the passenger was associated with the company or not, but he definitely has some rights and deserves to receive some justice for the injuries he’s suffered.
