Apparently, Smith hit both Tiffany and her son, then fled the scene. Tiffany and Adrian Guerrero were only slightly injured, thankfully.
Later on, the police apprehended Smith and he was arrested. He was allegedly under the influence at the time, so he’s now facing driving while intoxicated charge, along with causing an accident involving injury.

Commentary:
If alcohol was really a factor here, then considering the holiday weekend, I also have to wonder whether this man had been drinking somewhere like a bar beforehand. While the news and police tend to focus on the wrong actions of drunk drivers who cause accidents like this, I like to remind folks that things this often happen because two parties were negligent.
I’m talking about people who drink too much and drive and bars and the places that over-serve their customers. Texas law is actually very clear that bars (and other places with licenses to sell liquor) can’t serve alcohol to people who are a) obviously intoxicated or b) a clear danger to themselves or others.
If you’ve ever been to a bar and seen someone downing shots while falling off their barstool, that’s who I’m talking about. I think we can all agree that that person doesn’t need to be served any more alcohol and it’s irresponsible (not to mention unlawful) for a bartender to serve him anymore.
My point here is that if this man had been drinking at a bar that night, then they may also bear some liability for these folks’ injuries. The person accused of drunk driving is often blamed for the entire accident in these situations, but I’m here to remind people that bars are often involved as well.
