Commentary:
I can’t be too specific here, because we lack a lot of details. We’re not told what kind of machinery this man was operating, but I know OSHA has regulations in place regarding how workers be kept safe in dangerous work conditions.
It’s possible the employer was following all the rules, provided the necessary safety gear, and training to it’s employees. But that’s more assumptions than I would be comfortable making. A professional investigator would make sure all the necessary measures were in place, that all these elements were up to code. Because if it ends up coming out that workers aren’t given what’s needed in order to work in a reasonable safe work environment, someone needs to be held accountable for that.
Additionally, if the worker’s safety gear wasn’t well maintained or it malfunctioned as a result of a defect, that also needs to be found out.
Depending on which of these scenarios is true (if any) might change who the responsible party is pertaining to this accident. That’s why it’s so important to make sure someone looks at every wangle, so that the correct entity is held accountable.
