Local reports have said that the woman who was hurt in this accident wasn’t standing in a crosswalk at the time of the accident. Of course, it’s important for pedestrians to follow the rules of the road, and steer clear of moving traffic. However, in case they don’t, or are standing outside of a designated pedestrian zone for some reason, vehicles don’t have standing permission to crash into them. As a matter of fact, drivers have an obligation to avoid accident if at all possible. Obviously, there are times when there’s no time to react, and avoiding an accident isn’t possible. But when a driver isn’t paying attention to the road, or is going above the speed limit, the fact that the pedestrian was standing outside a crosswalk isn’t going to indemnify them from liability. Now, I’m not saying that the driver involved in this accident is definitely to blame for what happened. I’m just trying to illustrate the fact that these things aren’t always as black and white as some believe them to be.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
