Rhine, WI — Two people were involved in a dump truck accident that took place in Rhine, Wisconsin, on Tuesday, August 11, 2105. The accident took place on County Line Road, at the intersection with Highway 32.
Police say that 44-year-old David Morris was headed west on County Line and stopped to make a turn onto 32. A dump truck traveling behind it and being driven by 29-year-old Douglas Berges rear-ended Morris, sending both vehicles into a ditch on the side of the road.
No serious injuries were reported, but the exact conditions of Morris and Berges are unknown.
Officials say that the accident may have been caused by a brake failure in the dump truck.

Luckily, this accident wasn’t as bad as it could have been. However, I’ve seen accidents in which brakes have failed that turned out to be quite bad. In those cases, the driver of the dump truck will have a workers’ comp claim — provided their employer carries workers’ comp — but may also have a negligence claim, if the company knew the truck needed maintenance, but just never did it. If they were aware that not having that work done posed a danger to their employees, not to mention those they were sharing the road with, then that’s something they need to be held accountable for. Now, it’s very possible that something here’s being missed, or is going unreported. Maybe the brakes didn’t fail. But like I said, I’ve seen it happen before, so it’s something that should definitely be looked at here.
