Commentary
It’s important to remember that there are two components to accidents like this. The first involves the fact that it happened while the victim was on the job. That means that they’ll very likely be eligible for workers’ comp benefits. Workers’ comp law usually prohibits an injured employee from filing any type of claim against their employer, but those laws don’t apply when it comes to third parties. That brings us to the second component. When a third party is found to be responsible for an accident — like, say, a driver who’s not watching out for tow trucks on the road — the victim can file a claim against them. Let’s keep in mind that the driver of the Civic nearly killed this man. He needs to be held responsible for what happened here.
