Local reports say that the truck in question belongs to FMP Transport LLC, which is a contractor for the USPS. Technically speaking, this makes them a third party. Now, whenever a worker is hurt in the an accident like this, their employer will usually have a workers’ comp policy that will step in an pay out benefits to cover hospital bills and things like this. Workers’ comp laws — in most cases — won’t allow an injured employee to pursue a negligence claim against their employee, but will allow them to pursue a claim against any third parties involved in the accident (provided they contributed to the accident happening). But, beyond the actual law that governs accidents like this, we just have to take a very realistic look at what happened. When you’re backing up, things come from behind you. You look behind you to make sure you don’t hit these things. It sounds like the driver involved here wasn’t doing as good a job with that as he should have been, and that’s something he needs to answer for.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
