Typically, whenever an employee is injured in an accident, the employer will have a workers’ comp policy that will step in and pay out benefits to the victim. So, while the victim is able to pursue a workers’ comp claim, they’re also able to pursue a negligence claim against the party responsible for the accident. However, as the accident still happened while the victim was on the job, pursuing the claim against the other party won’t affect the workers’ comp benefits that they’re still eligible for.
