Several things could have caused an accident like this to happen, so I wouldn’t want to speculate too much. However, I can say, based off of similar accidents I’ve seen in the past, that if the accident is found to have been caused because of any action the driver took, then they can be held liable for any injuries caused to their passengers. Drivers owe their passengers a certain duty of care while they’re out on the road. If a driver is acting irresponsibly, and that leads to an accident, then that duty is considered breached, and the driver can be held responsible for it.
