Employers will usually have a workers’ comp policy that will step in and provide benefits to workers who have been injured in on-the-job accidents. However, except in a few cases, those policies forbid employees from bringing claims against their employers. Now, those same policies don’t apply whenever an accident is caused by a third party. This is why, whenever an accident involves a piece of machinery or equipment, it’s always a good idea to that the machine or the equipment checked out, to make sure that a defect or a malfunction isn’t what led to the accident happening. If the accident did occur because of a defect in the machine, the manufacturer could possible be held liable.
