Fremont, IN — Two people were injured in a possible DUI accident in Fremont, Indiana, on Friday, July 10, 2015. The accident took place at the intersection of State Road 120 and County Road 175 W, around 11:00 at night.
Local sources say that a vehicle being driven by 36-year-old Travis Crager drove off the road and into a ditch before crashing into a tree. Crager suffered a leg and face injury and was airlifted to a local hospital. Twenty-six-year-old Nicholas Vancuren suffered a head injury and was also hospitalized.
Police believe that Crager lost control of his vehicle while negotiating a curve in the road. They believe that alcohol may have played a role in the accident. Police are continuing to investigate.

One thing that’s always important to check in an accident like this is whether or not a bar was involved. Indiana law forbids bars from over-serving customers who are obviously intoxicated, and they can be liable whenever that law is broken. It’s possible that there is no bar involved here at all, but it’s definitely something that should be checked up on. Aside from that, it seems as if the driver here has breached the duty of care he owed his passenger in causing the accident. I don’t know all the details of what happened here, so it’s possible I’m missing something, but in similar accidents I’ve seen in the past, drivers are held liable for injuries that their driving causes passengers.
