People are very quick to forget the rights of passengers in accidents like this one. When a driver is responsible for an accident, they’re of course liable for those they injure in the other vehicle. But what about passengers they’re traveling with inside their own vehicle? Well, if a passenger is injured because of an unsafe action taken by the driver, then the driver can be held liable for it. Drivers owe their passengers a certain duty of care out on the road. If the driver isn’t driving responsibly, then that duty is considered breached, and the driver can be held liable for it.
