Emerson, NE — One person was killed and three were injured in a two-vehicle accident near Emerson, Nebraska, on Wednesday, July 8, 2015. The accident took place on Highway 35, just east of the city.
Police identified the man killed in the accident as 52-year-old Todd Benjamin. Benjamin was headed west on the highway when he drifted into the oncoming lane, striking an eastbound SUV pulling a trailer.
The accident happened around 3:30 in the afternoon.
Benjamin died in the accident. Three passengers inside his truck suffered minor injuries and were taken to a hospital in Sioux City for treatment. Two people inside the SUV weren’t hurt.
What caused the accident is unknown. Police are currently investigating.

If someone gets into an accident with another vehicle, they know that they’re going to be held responsible for any damage they cause to that vehicle and to anyone inside it. But what about the people they’re traveling with? What about their passengers? If they’re hurt in an accident, who’s responsible for that? A lot of people don’t know that the driver responsible for the accident can also be held liable for his passengers’ injuries.
