Dump Truck Accident On Lincoln Avenue Injures 2 in Oakland, CA


Oakland, CA — On Monday of this week, July 6, a dump truck caused a major accident near I-580/MacArthur Freeway in Oklahoma
after its brakes allegedly went out and it crashed into some stopped cars and a bicycle. This happened at the intersection of Montana Street and Lincoln Avenue.

According to the reports, the dump truck was headed west along Lincoln Avenue/Champion Street on Monday when it lost it brakes – the driver claimed – while going down a steep hill.

The dump truck lost control and swerved into two parked cars, then hit a bicyclist.

Two people were injured and taken to a hospital, where they were in non life-threatening condition. The reason for the accident is still being investigated, though the dump truck insists that the brakes failed on his truck.

One of the injured folks appeared to be a young man in his early 20’s or late teens and the other appeared to be a grown man in his 30’s or early 40’s.

Commentary:

There are two things to consider here: the alleged “lost” brakes and the fact that this dump truck driver just might not have been paying attention that day. Both are major issues that need to be addressed, but with different parties. If, for example, it turns out that this dump truck driver just speeding and couldn’t slow down in time, or he had been playing with his phone, then he would be considered responsible for the accident — possibly along with whoever hired him.

But, if the brakes were the culprit here and were defective, then whoever installed them may have to answer for some poor work. Alternatively, the manufacturer of the brakes themselves may have sold/designed a shoddy product. Both of these scenarios stick out to me and they both require some thorough, independent investigating.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
