In an accident like this, you of course are going to want to know exactly how the forklift figured into things. Sometimes people use machines improperly, and others get hurt. Sometimes, machines malfunction and cause people to be hurt. Typically, workers’ comp would step in and handle an accident like this. However, if the machine malfunctioned, causing the injury, then the injured worker could have a potential injury claim against the manufacturer. Right now, we don’t know. It’s possible that’s not the case here, but it’s definitely something that should be looked at.
