People who drive commercial vehicles are always going to be held to a higher standard, because they’re capable of causing such a great amount of damage with only a single mistake. And it seems as if that’s what happened here. A driver made a mistake, and someone paid the price for it. Luckily, the accident wasn’t nearly as bad as it could have been.

Now, despite the fact that this wasn’t done on purpose, and that it could have been worse, doesn’t mean the dump truck should get a Get Out of Jail Free card. They’re still liable for the crash, and will have to find a way to make things right with the man they’ve hurt. This also doesn’t mean that questions shouldn’t be raised about the driver’s attention to safety, and whether or not a mistake like this is really a one-time thing.

For victims involved in these accidents, the time immediately following the crash is critical. Evidence needs to be collected. And once it is, you need to know what to do with it. This is where the experience of professionals who have handled accidents like this can be extremely helpful. Most people have no experience at all with accidents like this. Trucking companies, on the other hand, have nothing but experience, and will typically try to shove of as much liability as they can off of themselves and onto another party. When navigating unfamiliar waters, it’s easy to be taken advantage of, and that’s exactly what you want to avoid.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
