Commentary:

News reports indicated that this UTV was only designed for two people, but for some reason, six teenage girls were loaded on it at the time of the accident, so my question would be, who thought this was a great idea? I have a feeling these teenagers don’t own the UTV themselves, so who decided to give them the keys? Were the owners of the UTV observing six people on a two-person vehicle? If the owners of the UTV were aware that the people they’d given it to were not using it properly, yet did nothing to correct the improper behavior or properly instruct them on appropriate use, there may be a chance that the owner of the UTV could be liable for what we in the legal field call negligent instrument, which is akin to giving a child a loaded gun, or allowing somebody with zero training to operate complex heavy machinery. Somebody needs to look into this accident and really start asking some hard questions to the right people, because from what I’ve read in the news, a lot went wrong here.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
