Alleged DUI Accident Injures Six Children and One Adult in Fishers, IN


Fishers, IN — Seven people were hospitalized in what police believe was a drunk-driving accident in Fishers, Indiana, on Monday, June 1, 2015. The accident took place on Southeastern Parkway, around 7:00 in the evening.

Police say that a vehicle being driven by 21-year-old Carter James was headed east on Southeastern Parkway and drove off the road. The car lost control and came back on the road, where it drove into the oncoming lane of traffic and crashed into a westbound van.

One adult and six children, ages 5-16, were inside the van at the time. All seven were taken to IU Health Methodist Hospital. James, along with two others inside her vehicle, weren’t injured in the accident.

Police investigated the scene and determined that she was intoxicated at the time of the crash. She was arrested and has been charged with DUI causing serious bodily injury.

Commentary

If the driver was drinking at a bar at some point before the crash, then it’s possible that Indiana law could hold them partially liable for the crash. But even if no bar is involved, things here look pretty bad. If the driver was indeed drunk, then she put the lives of those children at risk, and alongside the charges she’s currently facing, is now facing injury claims for every one of those children.

Decisions to drink and drive are stupid, and do no good for anyone. Regardless of how this plays out, the driver needs to be held responsible. Accidents like this very often turn out much worse than this one did. The next van-load of children may not be so lucky.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.
