Gilbert Madrigal Injured in Semi-Truck Accident in Waldo, FL


Waldo, FL — Two people were injured in a semi-truck accident that left a woman dead on Tuesday, June 2, 2015. The accident took place on Highway 301, around 10:30 in the morning.

Stanley Cherichel was driving a Volkswagen Jetta that crossed into the oncoming lane of traffic and crashing into the side of a semi-truck. Soyla Ortiz-Cabrera, a passenger inside the Jetta, died in the accident. Cherichel and Gilbert Madrigal, another passenger, were injured and taken to UF Health Shands Hospital.

At last report, Madrigal was listed in stable condition. The full extent of his injuries is unknown.

What caused the accident is still being investigated.

Right now, we seem to know what happened in this accident, but we don’t know why it happened, and that’s going to be important in determining who’s held responsible for it. I will say that, in similar accidents I’ve seen in the past, a driver is held responsible for any accident he causes that brings about any sort of injury to his passengers. Drivers owe a duty of care to their passengers, and if a passenger is hurt because of something they — directly or indirectly do — they can be held responsible for it. Now, I’m saying that the driver is at fault for what happened here. We don’t know that yet. I’m just saying that drivers have a responsibility to more than just other drivers out there.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
