Commentary:

As with the overwhelming majority of pedestrian-involved accidents, the fault is going to rest largely on the placement of the victim when they were hit. If the victim was in any kind of marked crosswalk protected by a light, sidewalk, pedestrian or biking lane, or a parking lot, chances are the driver is going to take home the lion’s share of the fault. On the other hand, even if the victim was not in an area that lent them the right-of-way, if the driver of the car that hit them had ample opportunity to react, but failed to because they were distracted by a cell phone or not paying attention to the road ahead, the driver can still bear a significant portion of the liability in the accident. Considering how barren of important details the news is, if anybody knows anything more, or witnessed the accident with their own eyes, I’d be interested to hear their side of things. No detail is too insignificant in cases like this, and every little voice can help a great deal.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
