Clinton, WI — A man was hospitalized following a car accident in Clinton, Wisconsin, on Thursday, May 14, 2015. The accident took place at the intersection of highways 140 and 67, around 4:30 in the afternoon.
Thomas Maslauskas was identified as the diver of a 2008 Hino van headed east on Highway 67 when he ran a stop sign and crashed into a 2012 Mazda being driven by 55-year-old Frederick Kobylinski.
Kobylinski suffered critical injuries in the crash and was taken to Rockford Hospital. Maslauskas was not hurt in the crash.
Police investigating the accident say that Maslauskas was not intoxicated at the time of the crash. He’s been cited for failure to yield.

It’s important to realize that what the police find in an investigation and what they charge (or don’t charge) a driver with is not necessarily the end of something like this. Even if police don’t charge someone following an accident like this, that person could potentially have a claim filed against them by the victim or the victim’s family. This is the civil side of an accident. When police press charges, that is the criminal side. Often, victims won’t file a claim, worrying that the civil charges will negatively impact the criminal. This is not the case, and I’ve seen several investigations in the past in which a civil investigation was able to provide a criminal case with evidence that it had missed. So for those worried about one side negatively effecting the other, those concerns tend to be unfounded.
