I’m a little confused as to how this accident happened. Reports make it sound as if the victim was directly in front of the vehicle when the crash took place. If that’s the case, then there should have come a point at which the drive of the semi-truck should have been able to see the pedestrian with his headlights turned on. If the truck was turning into a parking lot, the driver should have been going slow enough — not to mention paying attention to the road — to avoid the accident.

Regardless of how the accident happened, I wouldn’t be surprised to see the trucking company attempt to defend it. Trying to push liability off of themselves and onto others really is their MO. In that case, those involved will want to consult with experienced professionals, and even consider launching a private investigation into the accident. That sort of thing can be immensely helpful. After all, your typical person has no experience with these sorts of accidents, while trucking companies have nothing but.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
