Right now, we know very little about what caused this accident. The truth of the matter is, many things could have caused it. However, in many accidents like this that I’ve seen in the past, liability ends up falling on the driver, barring the involvement of some third party, or a defective automobile. Drives owe their passengers a certain duty of care while they’re out on the road together. If a passenger is injured because of a driver’s actions, that duty has been breached, and the driver can be held liable.
