Commentary:
Now, people need to understand that just because these workers were on the job at the time they were hit by a car, it does not shoehorn the victims into a workers’ compensation resolution. In reality, the workers may be able to file a workers’ comp claim with their employer, in addition to a claim against the insurance policy of the offending driver. Because workers’ compensation alone tends to yield a great many drawbacks and disadvantages, having the option to pursue both claims tends to benefit victims far more in the long run than simply choosing one or the other.
