Commentary:
The news said two things that would more than likely put the driver of the van at fault for the accident. First of all, the van struck a stopped vehicle from the rear, and the driver of the van was cited for speeding. The majority of rear-end collisions have to do with either speeding, or following too closely (tailgating). If the driver of the van was speeding, as the police allege, then he probably didn’t give himself enough stopping distance to avoid hitting the car in front of him, which in turn struck the victim due to the force. Granted, this is only based on a news report written shortly after the accident, but based on the news, the driver of the van is probably going to be on the hook for what happened, even if his vehicle didn’t directly strike the victim.
