Right now, we don’t know exactly what caused this accident, so I don’t think blaming the driver without knowing those facts would do anyone much good. Since I started practicing law, I’ve seen many accidents that looked just like this one, and many of those happened for reasons that had nothing to do with the driver. Sometimes they’re caused by loads shifting inside the truck. Sometimes they’re caused because some part in the vehicle was defective. In those cases, liability could potentially fall on a third party, such as a manufacturer.
What’s important in this accident is to see whether or not both individuals inside the truck worked for the same company. If the accident was the driver’s fault, then this will likely be handled through the employer’s workers’ comp policy. However, if the second individual inside the truck was not an employee, then workers’ comp wouldn’t apply to him and he would be free to bring a claim against the trucking company. Obviously, more investigation is needed to know for sure.
