Construction Accident in Milpitas, CA, Injures One on Dixon Landing Road


Milpitas, CA — A person was hospitalized following a construction accident in Milpitas, California, on Monday, March 16, 2015. The accident took place at the Spinnaker Pointe Apartments, around 2:15 in the afternoon.

Reports say that a piece of equipment used to hold up walls came loose at the site of some construction and hit someone standing nearby. The person was fell and hit their head before falling in a hole filled with wet concrete.

Personnel with the Milpitas Fire Department were called in, and were able to use a ladder lowered over the hole the individual fell in to reach him and bring him out.

The victim’s name was not released. Emergency workers took the man to a nearby hospital. The extent of his injuries is unknown. The accident is being investigated.

How an accident like this is handled is really going to depend on who the victim was. If he were just a passerby, someone who lived at the apartment complex, then the construction company and the complex itself could be held liable for the accident. Especially if the accident involves malfunctioning equipment and a construction area that may not have been as well marked off as it needed to be. If the victim here was an employee, then this would most likely be handled through workers’ comp. However, if a piece of equipment malfunctioned, and that led to the employee being injured, it’s also possible that liability for the accident could fall on the equipment’s manufacturer. Hopefully the investigation into the accident sheds some light on things.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
