Temple, TX — Five people were hospitalized following a chemical spill at an industrial plant in Temple, Texas, on Tuesday, January 27, 2015. The accident happened at Carpenter Co., a company which, according to their website, creates comfort cushioning products, such as bedding.
Four employees at the plant began complaining of breathing problems after a chemical — identified as toluene diisocyanate — was spilled. Those four employees were taken to a local hospital. A firefighter who came into contact with the substance was treated at the scene.
The names of those involved, or if their injuries will have any lasting effects, are unknown.
Police are investigating the accident. What caused the spill is unclear at this time.

Commentary
Liability in an accident like this is really going to depend on how the accident happened. Was the spill a result of a defective piece of equipment? That could fall back on the manufacturer. Were employees from any other company somehow involved? If there were, and it turned out that something they had done caused the accident, they could be held responsible for it. A work accident will usually be handled through an employer’s workers’ comp policy, but every accident can be a little different, and those differences can dictate the way they’re handled.
