Commentary:

With this accident, the thing I’m most curious about is how many different companies and contractors were working at the site. What significance do these questions hold? Well, if it was only one company operating at the site, then this would probably be just a work accident, and workers’ compensation may be the only solution. However, rarely do oil, gas and fracking sites operate without contractors and subcontracting companies. If one of these companies happened to cause the explosion, and the victim was working for another company, this would may not be as simple as a work accident. This would be a regular negligence claim against a company, and the victim would be no different than if he were hurt by a companies actions while walking down the street. The main difference? Workers’ compensation strips employees of their ability to sue in exchange for a quick no-fight benefits package. The problem being, companies know that employees cannot fight for more compensation, so they’re usually very low ball figures. If another company caused this accident, then the victim would have all these rights restored.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
