Commentary
There are still a few things we don’t know about this accident. Police are currently waiting to see whether or not the victim had been drinking at the time of the crash. Montana’s laws are similar to those in Texas which say that, if a person is served alcohol while visibly intoxicated, a bar can be held liable if that person goes out and gets into an accident. This accident happened around 2:30 in the morning. Accidents involving alcohol typically occur late at night or very early in the morning. However, alcohol obviously isn’t the only reason an accident can occur at this time of night. It’s possible that the victim fell asleep at the wheel. As things stand now, it appears that the victim may be at fault for this accident, but it would be wise to hold off judgement until all the facts are in.
