Scene of the Accidnet
Paramedics who arrived on scene pronounced Marcos Ribeiro dead when they arrived. The driver of the vehicle was identified in the report as 30-year-old Assis Silva, who currently faces drunk driving related charges in connection with the accident.
Officials hope any eyewitnesses that have not yet come forward will do so in an effort to aid investigators in better understanding the nature of the accident.
Commentary:
It is accidents like this one that only serve to illustrate the necessity for the liquor liability laws the State of Texas is currently armed with. Many are unaware of this, but when a customer of a bar, liquor store, or alcohol serving restaurant is served outside regulations, the bar can be liable for any accident they cause right along side the accused drunk driver. This includes failing to cut somebody off, or serving somebody beyond the point of obvious intoxication. In this case, there could potentially be a third party liquor liability claim against the bar if the facts line up properly.
